Garnishment - When a third party (the garnishee) holds a debtor’s money or property, garnishment permits the creditor to seize that money or property in order to pay the creditor’s claim. Execution - Execution is the process of putting into effect the final judgment of the court. While garnishment takes property or money that is in the hands of a third party, execution takes property or money that is in the hands of the judgment debtor. Indeed, recent changes in Michigan law allow a judgment creditor to register a judgment lien against the debtor’s real estate. Courts have discretion to quash a writ of execution.
