Administrative agencies are often called the fourth branch of government. Administrative agencies pervade
virtually every aspect of private life and public life. Administrative agencies include state boards of education,
departments of energy, labor, and economic growth, as well as departments of health and human services.
WikipediA tells us that:
“Administrative law is the body of law that governs the activities of administrative agencies of
government. Government agency action can include rulemaking, adjudication, or the enforcement of a
specific regulatory agenda. Administrative law is considered a branch of public law. As a body of law,
administrative law deals with the decision-making of administrative units of government (for example,
tribunals, boards or commissions)[.]”
When a business or an individual is aggrieved by an agency action an administrative hearing may be requested.
Law.com defines an administrative hearing as:
“A hearing before any governmental agency or before an administrative law judge. Such hearings can
range from simple arguments to what amounts to a trial. There is no jury, but the agency or the
administrative law judge will make a ruling.”
In Michigan, administrative hearings are governed by statute (i.e., the Administrative Procedures Act (“APA”)
